What is RTE Act 2009?

The Right of Children to Free and Compulsory Education Act, 2009 (RTE Act) is a historic legislation in India. It guarantees that every child between the ages of 6 to 14 years has the fundamental right to free and compulsory education.

Enacted on 4 August 2009 and effective from 1 April 2010, this act made India one of the 135 countries to make education a fundamental right.

Key Legal Provisions

Section 12(1)(c): 25% Seat Reservation

Private unaided schools must reserve 25% of seats for children from weaker sections (EWS) and disadvantaged groups. This is the core provision that enables free admission.

No Screening Procedure

Schools cannot conduct any interview, test, or screening of the child or parents. Admission must be strictly random (Lottery Based).

No Captitation Fee

Schools are strictly prohibited from charging any donation or capitation fee. Education is completely free for these 25% seats.

    2002: 86th Amendment

    Article 21A was inserted in the Constitution, making education a Fundamental Right.

    Parliament passed the RTE Act.

    The Act came into effect across India (except J&K at that time).
